Terms of use

Agreement

These terms are an agreement between you and Stephane Nguyen (we, us), the developer of the Steady Tally app for iOS (the app). By downloading or using the app you agree to them. If you do not agree, do not use the app.

The app is distributed through the App Store. Apple's Licensed Application End User License Agreement also applies. Where these terms and Apple's agreement conflict, Apple's agreement governs your relationship with Apple and these terms govern your relationship with us.

Not medical advice

Medication features (dose times, dose windows, adherence, refill reminders, insights) are conveniences built on the information you enter. They can be wrong if that information is wrong, if a notification is not delivered, or if your device is off, silenced or out of battery. Insights and connections are statistical patterns in your own logs. They are not diagnoses, not predictions and not proof of cause.

If you have a medical question or emergency, contact a healthcare professional or your local emergency number.

License

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the app on Apple devices you own or control, as allowed by the App Store usage rules. The app, its design, icons, text and code are ours or our licensors' and are protected by copyright and other laws. You may not copy, modify, distribute, sell, lease, reverse engineer or create derivative works of the app except where the law allows it regardless of this restriction.

Your data

Everything you log belongs to you. The app stores it on your device and, if you turn on iCloud sync, in your private iCloud. We do not receive it. How the app handles data is described in the privacy policy, which is part of these terms.

You are responsible for keeping backups. The app offers a JSON export in its settings. We are not responsible for data lost through device loss, deletion, iCloud issues, operating system changes or removing the app.

Reminders and reliability

Notifications, Live Activities, widgets and Apple Health links depend on iOS features, your settings, Focus modes, battery state and permissions you grant. We do not promise that any reminder will be delivered at a particular time or at all. Do not rely on the app as your only safeguard for anything that matters to your health or safety.

Acceptable use

Use the app only for lawful purposes and only for tracking your own habits and medication, or those of a person who has asked you to. Do not attempt to interfere with the app, its distribution or Apple's services.

Warranty and liability

The app is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy and non-infringement, to the extent the law allows.

To the extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, health outcomes, missed or duplicated doses, or other losses arising from your use of or inability to use the app. Where liability cannot be excluded, it is limited to the amount you paid for the app in the twelve months before the claim, or ten euros, whichever is greater. Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence.

Apple

Apple is not a party to these terms and is not responsible for the app or its content. Apple has no obligation to provide maintenance or support for the app. To the extent the law allows, Apple has no warranty obligation for the app; any claim, loss, liability, damage, cost or expense attributable to a failure to conform to a warranty is our responsibility. Apple is not responsible for addressing any claim by you or a third party relating to the app, including product liability claims, claims that the app fails to conform to a legal or regulatory requirement, and consumer protection claims. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

You confirm that you are not located in a country subject to a U.S. government embargo or designated as a terrorist-supporting country, and that you are not on any U.S. government list of prohibited or restricted parties.

Termination

You can stop using the app at any time by deleting it. We may end this license if you break these terms. Sections about your data, warranty and liability, Apple and governing law survive termination.

Governing law

These terms are governed by the laws of Germany, without regard to conflict of law rules. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live.

Changes

We may update these terms when the app changes. The effective date at the top will change, and material changes will be announced in the app. Continuing to use the app after a change means you accept the new terms.
